Service Terms and Conditions

By accessing the services of Affordable USA Wide.net, customer agrees to and accepts the following conditions:

1. Services may only be used for lawful purposes. The act of committing any illegal act or transmission of material in violation of any laws of the United States or specific state legislation is strictly prohibited and is subject to immediate cancellation of services. This includes, but is not limited to, copyright material, threatening or obscene material or material protected by trade secret.

2. Affordable USA Wide.net, under no circumstances, whether expressed or implied, is not responsible nor shall be held responsible for any damages suffered from the use of Internet-related applications, paging or software and/or loss of data, non-deliveries or mis-deliveries of information or electronic mail, or service interruptions caused by the Internet, subscriber, USAWide.Net Services, or any other involved party. In addition. Affordable USA Wide.net is not responsible for any damages suffered from electronic mailing or posting of material that may be inappropriate or obscene.

3. Use of any information obtained via our services is at your own risk. You agree Affordable USA Wide.net is not responsible or liable and therefore, will not be held responsible in any court of law, for the accuracy or quality of information obtained.

4. Dedicated Access: Is available to customer 24 hours per day, seven days a week, with the exception of unforeseen outages and/ or network maintenance. Network maintenance is generally scheduled at off peak hours. The Number of Users on the Customer's Network may affect upload and download speeds.

5. Affordable USA Wide.net may disconnect customers dedicated access in the event customer or customer's network is disrupting the service of others.

Disrupting Affordable USA Wide.net's services or facilities: Using the Services or facilities for any activity that adversely affects the ability of other people or systems to use the Services or the Internet. This includes "denial of service" attacks against another network host or individual user. Interference with or disruption of other network users, network services or network equipment is prohibited. It is the customer's responsibility to ensure that their network is configured in a secure manner.

6. Outages should be reported to Affordable USA Wide.net immediately. Response times depend on Services contracted by customer and severity of outage.

7. Billing

a) Subscriber agrees to pay according to current billing policies and rates.
b) Billing begins on the first day of the creation of the account and is due on the same day of each billing period.
c) If payment is not received within ten (10) days of the due date, the member account may be suspended or closed.
Corporate Billing may be placed on your account, extending billing cycle to a (30) day window. Business Customers may request that their Business account receive Corporate Billing.
d) Credit card and bank debit card payments are automatically deducted each billing period. We are not responsible or liable for any bank fees or penalty charges assessed to customer for overdrawn accounts.
e) Customer is responsible for any additional fees associated with non-credit/debit card payment methods.
f) All access packages automatically rollover to the same type of access package. In the event that a change is needed, it is customer's responsibility to notify Affordable USA Wide.net.
g) If the account is canceled for any reason, setup, install and prepaid administrative fees are non-refundable. Administrative fees will also be assessed to reactivate canceled accounts. Business accounts require 30 day notice, prior to cancellation.
h) Billing disputes must be claimed within 60 days of the date that the error was billed to the subscriber.  Affordable USA Wide.net is not responsible for billing claims covering billings or charges rendered more than 60 days prior to customer's submitting said claim.
I) Affordable USAWide will not be held responsible for any Third Party Fees or Damages.
j) If an outage is found to have been caused by Customer premise network or customer supplied Equipment, a charge will be issued for the service call.
k) We reserve the right to change billing rates, fees and/or services at anytime by notifying you 30 days in advance of effective change.

8. Upon Customer's request, Service Level Credits will be issued equal to the length of time for any unscheduled Services circuit outage, provided that customer notifies Affordable USA Wide.net of said outage immediately and that we can reasonably determine that said outage was attributable to Affordable USA Wide.net and was not caused by any action or omission of the customer, customer's network, Third Parties and/or Third Party equipment. Customer must request credit in writing, immediately upon Service Restoration.

9. Cancellation

a) Customer is required and responsible for giving us thirty (30) days notice prior to cancelling account.
b) Cancellations should be made via US Mail, Fax, or by notifying your sales representative. We will then notify customer of any remaining obligations and make arrangements for proper billing or credits to be issued on the account.
c) The Subscriber will still be responsible for any fees or charges due up to the cancellation date. If Customer is under a Term Agreement, early cancellation fees of $450.00 may apply. If this is applicable to your agreement, it will be clearly stated on your original order.

10. These terms and conditions are subject to change without notice. Continued usage after the effective date of policy change constitutes acceptance of that policy. Updated policies are available upon request. These terms and conditions supersede all previous representations, understandings, or agreements.

11. Services are deemed performed in the State of Texas. These terms and conditions are subject to the laws of the State of Texas, and jurisdiction shall be only in the State of Texas, except wherein laws and rulings of the US Government supersede any rules or laws of the State of Texas.
